These terms set out the conditions for using My View Point.

These Terms of Use (“Terms”) set forth the conditions for using the browser extension provided by My View Point Developer (“we,” “us,” or “our”) and all related services (collectively, the “Service”). By using the Service, you agree to these Terms.

Article 1 (Content of the Service)

The Service provides functions that allow users to add, save, redisplay, and manage headings and other markers at positions within conversations and content on supported websites designated by us.

The Service provides features such as display assistance, organization, navigation assistance, and saved-data management, but it does not provide the supported websites themselves.

We may add, change, suspend, or terminate the functions, supported sites, display methods, and other content of the Service at our discretion.

Article 2 (Relationship with Supported Services)

The Service may operate on websites, services, platforms, or applications provided by third parties (“External Services”).

You are responsible for complying with the terms of use and any other conditions of the relevant External Services.

We are not involved in the continued availability, specifications, display structures, APIs, domains, functions, or any other aspects of External Services. Even if all or part of the Service becomes unavailable due to changes, suspension, restrictions, or malfunctions of External Services, we are not liable except in cases of our willful misconduct or gross negligence.

The Service is not part of any official product, official feature, or official support of any External Service.

Article 3 (Starting Use)

You shall begin using the Service in accordance with the methods specified by us.

Some features or paid features of the Service may require procedures designated by us.

Article 4 (Fees and Payment)

The fees, billing units, currency, billing timing, and other conditions for paid plans are governed by the information displayed on the Service’s pricing page.

Unless otherwise stated, paid plans are monthly subscriptions that renew automatically. Unless you complete the cancellation procedure specified by us or the payment provider before the renewal date, you agree that the paid plan will renew under the same conditions.

Payments are processed through external payment providers designated by us. You must also comply with the terms and conditions of such providers.

Fees already paid are non-refundable except where required by law. If you cancel during a billing period, no prorated refund will be made for the remaining days of that billing period.

Early supporter pricing, special pricing, campaign pricing, and other exceptional pricing are subject to the separate conditions displayed by us.

Article 5 (Cancellation)

You may cancel a paid plan using the method designated by us.

Even after cancellation, you may continue to use the paid plan until the end of the current billing period.

After cancellation, your plan will move to the free plan, and restrictions may apply, including limits on paid features and saved items.

Article 6 (Usage Environment and Restrictions)

Use of the Service requires a supported browser (Google Chrome), supported operating system, supported websites, and a stable internet connection. You are responsible for preparing your own usage environment at your own cost.

The Service does not guarantee the same behavior or display under all devices, environments, languages, regions, screen structures of External Services, or future specification changes.

Article 7 (Stored Data)

The Service stores headings, position information, display states, notes, settings, and other information necessary to provide its functions mainly in the storage area within your browser.

We do not guarantee the completeness, accuracy, permanence, or recoverability of stored data.

You are responsible for preserving and managing important information as necessary.

Changes to External Services, communication failures, browser behavior, device issues, account conditions, and other circumstances may cause heading positions to shift, fail to display, become unrecoverable, or be lost.

Article 8 (Prohibited Conduct)

You must not engage in any of the following when using the Service.

  • Conduct that violates laws or public order and morals
  • Conduct that infringes the rights, interests, honor, reputation, or privacy of us or third parties
  • Conduct that interferes or may interfere with the operation of the Service or External Services
  • Modifying, disassembling, decompiling, or reverse engineering the Service, except where permitted by law
  • Circumventing or attempting to circumvent authentication, licensing, limitations, or other protective measures of the Service
  • Improperly using the Service in combination with unlawfully obtained information, bots, scripts, or other automated means
  • Reselling, sublicensing, lending, sharing, assigning, transferring, or similar acts not expressly permitted by us
  • Using the Service for unauthorized access to third-party services, data extraction, interference with monitoring, or unauthorized operations
  • Any other conduct that we deem inappropriate

Article 9 (Intellectual Property Rights)

All intellectual property rights relating to the Service, including its programs, designs, displays, text, structure, and trademarks, belong to us or to legitimate rights holders.

The license granted under these Terms does not mean that any intellectual property rights relating to the Service are transferred to you.

Article 10 (Changes, Suspension, and Termination of the Service)

We may change, suspend, or terminate all or part of the Service for maintenance, incident response, specification changes, legal compliance, operational or technical necessity, or other reasons.

We are not liable for damage suffered by users due to such changes, suspension, or termination, except in cases of our willful misconduct or gross negligence.

Article 11 (Disclaimer of Warranties)

We make no warranties of any kind regarding the Service, including fitness for a particular purpose, completeness, continuity, accuracy, usefulness, safety, compatibility with External Services, uninterrupted operation, or freedom from errors.

We do not guarantee that the Service will produce results expected by users or that it will continue to be provided under the same specifications in the future.

Article 12 (Limitation of Liability)

We are not liable for damage incurred by users in connection with the Service except in cases of our willful misconduct or gross negligence.

Even if we are liable for any reason, such liability is limited to direct and ordinary damages, and the maximum amount shall not exceed the total amount of fees actually paid by the user to us during the three months immediately preceding and including the month in which the damage occurred.

We are not liable for damage caused by failures, specification changes, suspension, restrictions, account freezes, regional restrictions, or other external factors relating to External Services.

Article 13 (Suspension of Use and Termination)

We may suspend use of the Service, terminate the agreement, delete data, or take other necessary measures without prior notice if we determine that a user falls under any of the following.

  • Violation of these Terms
  • False registration information
  • Failure to pay fees
  • Interference with the operation of the Service
  • Any other case where we determine continued use to be inappropriate

Article 14 (Personal Information, etc.)

We handle information obtained in connection with providing the Service in accordance with our separately established Privacy Policy.

Payment information may be processed not by us but by the payment provider in accordance with that provider’s terms and conditions.

Article 15 (Changes to the Terms)

We may change these Terms as necessary.

The revised Terms become effective when notified through the Chrome Web Store listing page, notices within the Service, or any other method we consider appropriate, or on a separately specified effective date.

If you continue to use the Service after the Terms have been changed, you are deemed to have agreed to the revised Terms.

Article 16 (Governing Law and Jurisdiction)

These Terms are governed by and construed in accordance with the laws of Japan.

Any and all disputes between you and us relating to the Service or these Terms shall be subject to the exclusive jurisdiction of the Tokyo District Court or the Tokyo Summary Court as the court of first instance.
